Terms of Reference
The Project, approved by UNHCR’s Transformation and Governance Board aims at developing a Rights Mapping and Analysis Platform (RiMAP) for all operations. RiMAP will be an online, internal, integrated and institutionalized law and policy data and information platform enabling operations to identify the laws and policies defining the rights of refugees, asylum-seekers and stateless persons in a given country; analyze and measure whether these laws and policies ensure – in law – that refugees, asylum-seekers and stateless persons have access to their rights; and analyze and measure whether the country’s legal and policy framework is compliant with international and regional standards.
The platform is being developed by a RiMAP team within the Division of International Protection, but with the engagement of a wide range of internal stakeholders, including – at the start – all RPRF participating country Operations. To ensure, RiMAP efficiently and effectively tailors to the needs of country operations, being the ultimate key users of RiMAP, their early participation in the development of RiMAP is essential. In accordance with the TGB approved RiMAP concept note and the DIP confirmed budget, and to accommodate resource constraints in the participating country operations, support is provided to the participating country operations. This support will allow country operations to collect, map, and analyze laws and policies affecting the rights of asylum-seekers, refugees, and stateless persons in a timely manner and effectively contribute to the development of RiMAP.
Concise and detailed description of activities, including measurable outputs and delivery dates, impact indicators (what qualitative and quantitative results would be achieved upon completion of individual contract), performance indicators (time lines, value of the service rendered in relation to the cost, timeliness) and work plan: Description: Conduct a comprehensive mapping and analysis of existing legal and policy frameworks related to the rights of asylum seekers, refugees and stateless persons in Tajikistan.
Measurable Outputs: A comprehensive research on the legal and policy frameworks in Tajikistan related to 12 rights of asylum seekers, refugees and stateless persons, including an analysis with aspect linked to the conformity against international standards.
The Consultant is expected to follow the schedule below for the submission of questionnaires:
Timeframe: Description
10 October – 15 November 2024: Study the RiMAP methodology to understand the structured legal analytical framework and all requirements for the analysis. Collect relevant national and international legal documents, policies, and case law related to the rights of asylum seekers, refugees and stateless persons in Tajikistan . Conduct a preliminary analysis of the national laws, policies, and jurisprudence concerning the 12 selected rights of asylum seekers, refugees and stateless persons. Identify key aspects and provisions that require further examination and clarification. Perform an in-depth analysis of each of the 12 rights group using the RiMAP structured legal analytical framework. Prepare for completing the questionnaires based on the collected data and initial findings.

Submission of Questionnaires: RiMAP Freedom of Movement, RiMAP Social Protection, RiMAP Health.
23-29 November 2024:
Submission of Questionnaires: RiMAP HLP (House, Land and Property), RiMAP Education, RiMAP Liberty and Security.
30 November – 6 December 2024:
Submission of Questionnaires: RiMAP Nationality, RiMAP Family Life.
7-13 December 2024:
Submission of Questionnaires: RiMAP Asylum, RiMAP Statelessness, RiMAP Work and Workplace.
14-20 December 2024:
Submission of Questionnaire: RiMAP Documentation.
21-31 December 2024:
Submission of Revised Questionnaires (after receiving feedback).

Impact Indicators: Improved understanding of the legal and policy frameworks related to the rights of asylum seekers and refugees living in Tajikistan .
Duties and responsibilities
In close coordination with the RiMAP Coordinator, but under the supervision of the Tajikistan Protection Focal Point, the Consultant will be responsible for carrying out the following tasks in relation to the Rights and Mapping Analysis:
(i) Conduct a review of the governance and legal framework governing the protection of refugees, asylum seekers and stateless persons in Tajikistan, including the national legislation, international conventions, and relevant jurisprudence;
(ii) Update the information collected under the RPRF, in particular the mapping of national and international laws and policies applicable to 12 selected rights;
(iii) Using the RiMAP structured Legal Analytical Framework, conduct an analysis based on the relevant provisions of the national laws, policies and jurisprudence, regulating 12 selected rights;
(iv) Upload all the information collected into the designated online web application;
(v) Provide regular feed back to the RIMAP Coordinator in view of improving and updating the development process and working instruction for the RiMAP if necessary.
Deliverables:
The Consultant is expected to deliver the Rights Mapping and Analysis for Tajikistan with all data entered into the online application.
The consultant is expected to deliver the following outputs:
1. A study on the national structure and governance, including the judiciary, administrative and legislative, with the description of applicability and access for asylum seekers, refugees and stateless persons;
2. A mapping of the legal framework (national laws, policies, case law) applicable to around 12 rights group;
3. A detailed analysis of the relevant legal framework around 12 right groups with a description of conditions and restriction (de jure) and possible obstacles (de facto)
4. An assessment of the extent of conformity of the refugee and statelessness-related framework in Tajikistan with international standards.
The consultant should have relevant experience in legal research and analysis, and knowledge of international human rights standards and best practices. Preferably a minimum 3 years of research experience with specific focus on the on international human rights law.
